Terms and Conditions “Japan Sword Art” website. (Effective from June 1st 2018)

All descriptions / text (with regard to Japanese swords and related articles) at www.japanswordart.com, are described as accurate as possible by consulting the available documentation and knowledge.

All items on this website are antiques and authentic; unless otherwise mentioned. Check the condition and also read the description carefully. If you need more detailed information or other help, feel free to contact me by using the “contact form”.
1c.
Customers can NOT derive any rights from the following points:
- Spelling mistakes in the text and English grammar.
- If the description is not entirely correct.
- If pictures show some reflections or show colour differences .
If you are interested in an item(s) you like to purchase, please contact me through the “order form”.

On requested: the relevant item, you’re interested in, will be put on HOLD for you for the duration of 2 weeks.
Note:
During these 2 weeks you can transfer the payment. If the payment confirmation is not received within these 2 weeks, the reserved article will automatically be placed back on the website: You cannot assert any rights with regard to the reserved article.

Rules: Depending on the country / continent where you live, the customs and VAT / import tax rules can vary considerably!
Advise: Please check these (additional cost) in advance to avoid disappointments!
Remember: Every country and continent has its own rules on this topic.

Bank transfer fees are not included in the price! These costs will be charged to the buyer.
Note:
Bank, credit card company and PayPal can charge a certain fee. This is on top of prevailing currency exchange rates.
For more information regarding payment in Euro’s €, please contact your own bank or credit card company to find out these extra/ exact costs.
For your information: “Japan Sword Art” only accept Euros € as currency.

Once the payment is received “Japan Sword Art” will send the purchased item(s) to the buyer.
The buyer will be informed (by e-mail) whether the item will be sent by courier or registered mail.
All packages are accompanied with a tracking & trace number, so that the buyer can follow the package during the transport.
6.
Shipping fee is depending on which country it should be sent to! These costs will be charged to the buyer. Unless another agreed has been agreed with the selling party.
7.
I will personally take care that purchased item(s) will be wrapped correctly.
All swords purchased through “Japan Sword Art” are sent in a special plastic telescope tube.
This to be sure that the purchased Nihonto and/or Koshirae, will not be damaged during transport.
Standard cost for these special plastic telescope tube, which is provided with a screw cap on the top. (packing material) will be € 25,– (Euro).
8.
Parcels will be transported/send through the following companies: Post UPS, DHL, NL-post, EMS, FedEx, or any other reliable company. This partly depends on which company wants to transport Japanese antique swords.
Some courier companies do not ship antiques, antiques and / or replica weapons etc … to certain countries. This is partly due to the continuous changes in international laws.
If the buyer of the item in question (Japanese sword) still wants to have it shipped, then the responsibility of not passing through customs lies entirely with the buyer.
9.
If during the transport problems occur, such as: loss of property, theft or damage to the goods than courier company will be responsible for this. The value (as mentioned on the invoice) is an indication of the insurance value.
It is the responsibility of the buyer to read and check all clauses for loss of property, theft or damage to the goods. Each courier company applies different rules.
ATTENTION:
If the customer/buyer still wants to have the purchased item sent/shipped via a courier (UPS, DHL), everything is at the customer’s risk. This means that NO claims can be filed against “Japan Sword Art” about loss of property, theft or damage to the goods etc.
All correspondence with the courier company and insurance companies or lawyers must be conducted by the customer/buyer himself.
Should any of the above mentioned problems occur, “Japan Sword Art” will assist you in that cae as much as possible. But again “Japan Sword Art” is NOT responsible and therefore not a party in this!
10.
“Japan Sword Art” would like your special attention to the following:
The sale, purchase and possession of arms are subject to national laws and regulations. Please ensure that you are familiar with the laws and regulations of your country BEFORE placing a bid. The sale of weapons to persons under the age of 18 is prohibited. By placing a bid, you automatically declare that you are 18 years of age or older and that you have verified that you are allowed to legally buy such items in your country.
According to Dutch and international law it is not allowed to sell swords to persons younger than 18 years.
If I have doubts about the age of the buyer, I will ask for his/her ID such as Passport or driving license (soft copy) I need this proof of identity in case of an audit by the authorities.
11.
Sending goods to the United States?
International regulations for sending goods have become stricter. That is why the United States (US) will only accept goods from abroad if they know in advance what is in them. They want to receive this data digitally. This means that from now on you have to prepare and frank your package online.
12.
