Terms and Conditions “Japan Sword Art” website. (Effective from June 1st 2018)

All descriptions/texts (regarding Japanese swords and related items) on www.japanswordart.com are described as accurately as possible based on the documentation and knowledge available to me.

Unless otherwise stated, all articles on this website are antique and authentic. Please check the condition and read the item description carefully. If you need more detailed information or other help, please feel free to contact via directly through info@japanswordart.com

Customers can NOT derive any rights of the following points:
- Spelling mistakes in the text and the English grammar.
- If the description is not entirely correct.
- If pictures show some reflections or show colour differences.

On request of the buyer: the relevant article, you’re interested in, can be put on HOLD for you for the duration of 4 weeks.
Note:
If the agreed purchase price + shipping fee is not received within these 4 weeks, the reserved article will be automatically cancelled from the reservation: No rights can be derived from the reserved article.

Rules:
Depending on the country/continent where the buyer lives, the customs and VAT/import tax rules can vary considerably!
Advice:
It is the buyers responsibility to check these (additional costs) in advance to avoid disappointment!
NOTE:
Every country and continent has its own rules on this topic.

Bank transfer fee, exchange rate costs are the buyer’s responsibility!
Note:
Bank, credit card company and PayPal can charge a certain fee. This is on top of prevailing currency exchange rates.
For more information about the additional costs to transfer money (Euro’ s €) to a foreign account, I refer you to your bank, PayPal or other credit card company to inform yourself for these specific costs.
For your information: “Japan Sword Art” only accept Euros € as currency.

Once the agreed purchase amount + shipping fee has been credited to my account “Japan Sword Art” prepare the package and ship it to the new owner.
The buyer will be informed by email on which method the package will be sent. This was agreed in advance during the negotiation of the purchase price.
Packages are always shipped with the following conditions:
1- Insured.
2- Tracking & Trace number.
3- Registered mail.
6.
Shipping costs depend on the country to which it should be sent! These costs are for the account of the buyer.

All purchased items will be wrapped correctly.
Swords/Nihonto purchased through “Japan Sword Art” are sent in an extra strengthened special plastic telescope tube.
In this way, we try to prevent damage to the Nihonto you purchased during transport as much as possible.
NOTE:
“Japan Sword Art” is not responsible for damage caused during transport or by the costumes. reason, “Japan Sword Art” does not have any control over this.
If there are additional costs for packaging material, this will be discussed with the buyer in advance.

Parcels will be shipped through the following courier service companies: PostNL, EMS, FedEx, DHL.
NOTE:
Buyer should take into account that not all courier service companies are willing to transport Japanese swords!

Buyer should take into account that not all courier service companies are willing to transport Japanese swords!. This applies to both antiques and/or replica weapons etc… This is partly due to the continuous changes in international legislation and geographical unrest between countries worldwide.
If the buyer insists on having the purchased article “particularly Japanese swords and armour” shipped, then in such a case, the buyer must contact a courier service company of his own choice by himself. The buyer can then make direct arrangements with the courier service company.
The responsibility for having articles cleared by customs lies entirely with the buyer and the courier service company.
If during the transport problems occur, such as: loss of property, theft or damage to the goods than the buyer should contact the courier service company with which he went into business.
It is the buyer’s responsibility to read and check all clauses and company rules of courier service company with which he went into business on this.
9.
“Japan Sword Art” would like your special attention to the following:
The sale, purchase and possession of weapons are subject to national laws and regulations. Make sure you are familiar with the laws and regulations of your country BEFORE you place a bid on a Japanese sword. The sale of weapons to persons under the age of 18 is prohibited. By placing a bid, you automatically declare that you are 18 years or older and that you have verified that you are legally allowed to buy/own such article/weapon in your country.
According to Dutch and international law, it is not allowed to sell swords to persons under the age of 18.
In case of doubt about the age of the buyer, his/her identity document will be requested, such as a passport, driver’s license or other ID (soft copy). I need this identity document in case of a check by the government/legal authorities.
10.
Sending goods to the United States!
The international regulations for sending goods to the United States have become very difficult. The United States only accepts goods from abroad if they know in advance what is in the package. The United States wants to receive this information digitally. This means that the package to be sent must be prepared/offered online. In most cases, special forms need to be filled.
Because unfortunately I have had less good experiences with shipping packages to the United States, I recommend the following:
You contact/organizes a courier service company of your own choice.
With the instructions to the courier company, to collect the parcel from my home address in The Netherlands.
